Legal metrology in Armenia

Organizations involved:

The Ministry of Economic Development and Investments of the Republic of Armenia is the Authorized Body in Metrology.

 

Armenia’s national metrology institute (NMI) is the “National Institute of Metrology” CJSC (NIM). The “National Institute of Metrology” CJSC is the National Body of Metrology.

 

The NIM ensures the uniformity of measurements in the territory of the Republic of Armenia through legal metrological control, i.e. type approval, verification and expertise in the following fields:

• commercial transactions between the buyer and the seller, calculations between the producer and consumer;

• healthcare;

• environmental, occupational safety assurance and accident prevention;

• road traffic surveillance and evaluation of technical state of transportation means;

• measurements performed by assignment of court, arbitrage, prosecution office and judicial organs;

• conformity assessment assigned bodies;

• military field.

 

The “National Institute of Metrology” CJSC (NIM) is responsible for the training and education in legal metrology tasks.

Legal metrology in Germany

Organizations involved:

The Federal Ministry of Economics and Technology “Bundesministerium für Wirtschaft und Technologie” (BMWI) is in charge of legal Metrology.

 

Germany's national metrology institute (NMI)  is the "Physikalisch-Technische Bundesanstalt" (PTB). The PTB establishes the basis for scientific, industrial and legal metrology. It is PTB's task to realize and disseminate the legal units, to approve measuring instrument types, to test standard instruments for the verification authorities and the state-approved test laboratories, and to give advice to the verification authorities and test laboratories. PTB is the federal authority responsible for legal metrology.

 

In Germany, the verification authorities are in charge of the verification of measuring instruments subject to verification act and the market supervision of measuring instruments. Because of the fact that Germany consists of federal states, the verification authorities are appointed by the 16 federal states.

 

The Working Group for Metrology and Verification (AGME) is the coordination bord of the verification authorities. The AGME ensures a uniform interpretation and application of the legislation.

 

The German Academy for Metrology (DAM) is responsible for the training and education in legal metrology tasks.

 

The verification of instruments for measuring electricity, gas, water and heat is mainly carried out by state-approved test centres.

Legal metrology in Belarus

Organizations involved:

 

The State Committee on Standardization of the Republic of Belarus (Gosstandart) is in charge of Legal Metrology.

Gosstandart is responsible for legal metrology infrastructure in Belarus and ensures development and a uniform interpretation and application of the national legislation.

 

The Law No 163-3 "About uniformity of measurements" (The Law on metrology) was approved in 2006. Several Directives and Ordinances of Gosstandart were developed to support realization of the law. Measuring instruments used by legal entities in their activities are subject to compulsory metrological control i.e type approval, metrological validation, verification and calibration. This metrological control is carried out by accredited laboratories and metrology divisions of legal entities.

 

Notified National Metrology Institute (NMI) is Belarussian state institute of metrology (BelGIM), see www.belgim.by. BelGIM realize and disseminate the legal units by developing and maintaining national measurement standards, approves types of measuring instrument, offers verification and calibration of working standards and measuring instruments to industry and research organizations, gives advice to Gosstandart and industry on metrology issues etc.

 

There are 16 verification authorities situated in 6 regions of Belarus. In Belarus verification authorities (BelGIM and Centers for standardization, metrology and certification (CSMC)) are in charge of the verification of measuring instruments used in legal metrology applications and of the market supervision of measuring instruments. They also offer verification and calibration to industry.

 

There is an educational system of Gosstandart responsible for the training and education in metrology.

The general list is given in Gosstandart Ordinance No 17. Ordinance No 17, 16 of March 2007 also specifies basic reverification\recalibration intervals. Actual intervals are given for the approved types of measuring instrument and can be found in the state Register of measuring instruments (as table’s column “MПИ”).

The criteria for attributing measuring instruments to legal metrology is given in the No 163-3 “About uniformity of measurements”, article 16.

Legal metrology in Lithuania

Organizations involved:

 

The Ministry of Economy of the Republic of Lithuania is in charge of formation the policy of Metrology in Lithuania.

 

State Metrology Service under the Ministry of Economy is in charge of legal metrology in Lithuania. State Metrology Service is responsible for the formation and organization of measures to implement the metrology policy in Lithuania, coordination of uniformity of measurements, carrying out implementation of legal metrological regulation, as well as for exchange of information on verification of measuring instruments and notification of bodies with the other EU member states.

 

Lithuanian Metrology Inspectorate under the Ministry of Economy controls how legal and natural persons observe the Law on Metrology of the Republic of Lithuania and other legal acts related to legal metrology. The Inspectorate executes state metrological inspection control of the condition and use of measuring instruments and the product quantities, protects the rights of the state and consumers from the effects of incorrect and illegal measurements.


Lithuanian National Accreditation Bureau (LA) under the Ministry of Economy accredits testing and calibration laboratories, certification bodies for products, quality and environmental management systems and persons and inspection bodies. LA also assesses certification and inspection bodies and testing laboratories proposed by authorized institutions for notification to perform conformity assessment procedures according to the New Approach Directives.

The Law on metrology determines the fields of using measuring instruments, where verification is mandatory:

1) the value of goods, services, content and value of direct sales transactions between the buyer and the seller and for some goods and services, if their measured quantity causes price;

2) the fine and the amount of damages awarded;

3) health care, veterinary, environmental and work conditions safety;

4) banking, taxation, customs and postal operations;

Legal metrology in Russia

The structure of Federal executive authorities of the Russian Federation involved in the work of Legal Metrology:

 

1. Ministry of Industry and Trade of the Russian Federation (Russian Ministry of Industry) is coordinating and monitoring activities under the Ministry of the Federal Agency on Technical Regulating and Metrology (Rosstandart) and adopts the following regulatory legal acts:

State Scientific Metrological Centers are responsible for the establishment, improvement, storage and use of state standards, as well as for the development of regulations of assurance of measurement uniformity. Scientific centers are the keepers of national standards, conduct research in the field of measurement theory, principles and techniques of precision measurements, development of scientific and methodological bases of improvement of the Russian system of measurement.

 

5. The bodies of the State metrological service are also 90 state regional centers of metrology, located throughout the territory of Russia.

They carry out work on the verification and calibration of measuring instruments, carry out state metrological control and supervision of the assurance of measurement uniformity.

 

6. Other State services are also liable for assurance of measurement uniformity:

  • State service of time and frequency, and determine the parameters of the Earth's rotation (GSVCh) provides: inter-regional and inter-sectorial coordination activities under assurance of measurement uniformity of time, frequency, and determine the parameters of the Earth's rotation, provide reproduction, storage and transfer of units of time and frequency of the atomic scale, and the World coordinated Time, the origin of Earth's poles.
  • State service of standards samples of composition and properties of substances and materials (GSSO) is organizing the creation and use of standard samples of composition and properties of substances and materials (metals and alloys, pharmaceuticals, minerals, soils, etc.). The service also provides a means of comparing the characteristics of the development of standard samples with the characteristics of substances and materials that are produced by industrial, agricultural and other businesses for their identification and control.
  • State service of standard reference data on physical constants and properties of substances and materials (GSSSD) is developing reliable characteristics of the physical constants, properties of substances and materials, minerals, etc., periodically publishing reference data.

Legal metrology in Azerbaijan

Organizations involved:

State Committee for Standardization, Metrology and Patent of the Republic of Azerbaijan (SCSMPRA) and its State Metrology Department www.azstand.gov.az are in charge of Legal Metrology.

Azerbaijan's national metrology institute (NMI)  is the National Metrological Centre. The NMC establishes the basis for scientific, industrial and legal metrology. NMC disseminates the legal units, maintains measurement standards and offers their calibration to the verification authorities. Tests in legally controlled area are performed by Research and testing department of SCSMPRA (AzTEST)

In Azerbaijan verification authorities are in charge of verification of measuring instruments subject to legal metrology control and the market surveillance of measuring instruments. The surveillance is performed by State control service in the field of technical regulation and standardization under SCSMPRA and 7 notified bodies.

Legal metrology in Moldova

Organizations involved:

The Central Metrology Authority (CMA) - The Ministry of Economy of the Republic of Moldova is in charge of the development and implementation of the state policy in the field of metrology, the management and coordination of activities at the national level, including the responsibilities in the field of legal metrology.

 

The main responsibilities of the Central Metrology Authority are the following:

• Development of draft laws and regulations and participation in the development and coordination of draft laws and normative acts, in order to ensure the traceability of measurements’ results to the International System of Units (SI) through procedures recognized and accepted internationally;

• Approval, within its competence, of the legal metrology general regulations and legal metrology norms, as well as the examination of draft normative acts, applicable in the field of metrology;

• Approval of national standards;

• Authorization of legal entities to carry out verification of measuring instruments subject to legal metrological control, to perform measurements in areas of public interest, as well as monitoring the activity of the authorized legal entities;

• Coordination of training programs in the field of metrology.

 

The main responsibilities of the National Institute of Metrology are the following:

• Ensuring the traceability of measurements to the International System of Units (SI);

• Carrying out technical work in the field of legal metrology (type approval, primary, periodical and expert verification of measuring instruments, official measurements, metrological examination of normative documents developed for the different areas of measurements);

• as well as registration of legal entities and individuals, which carry out repair, rental, sale, installation works, and works of putting into operation of measuring instruments on the basis of a declaration on their own responsibility.

 

In the Republic of Moldova, authorized laboratories are responsible for the verification of measuring instruments subject to legal metrological control. Currently there are 9 laboratories, including private laboratories, which are authorized by the Central Metrological Authority.

 

The supervision of the authorized laboratories is carried out by the Agency for the Protection of Consumer Rights, which performs the function of the metrological supervision and control.

Legal Metrology in Kazakhstan

Legal Metrology in the Republic of Kazakhstan The legal basis for activities in the field of ensuring the uniformity of measurements of the republic is the Law of the Republic of Kazakhstan "On ensuring the uniformity of measurements", "On technical regulation", "On accreditation of conformity assessment", as well as the Strategy of industrial-innovative development, Medium-term plan of socioeconomic development, Strategic plans of the Ministry on Investment and Development, Committee for Technical Regulation and Metrology and RSE "Kazakhstan Institute of Metrology".

 

Legal and regulatory fund in the field of metrology includes the Republic of Kazakhstan "On ensuring the uniformity of measurements", 4 decisions of the Government of Kazakhstan, 10 orders of the MIR RK and CTRM, more than 350 national standards and regulations in the area of traceability, 2 international treaties and agreements, to which the Republic of Kazakhstan has joined and 5 legal acts in the area of traceability of the Eurasian economic Union (EAEC).

 

In the Republic of Kazakhstan the activities in the field of metrology are regulated by the Law "On Uniformity of Measurements", which establishes the legal, economic and organizational bases of the uniformity of measurements. The law is aimed at protecting the rights and legitimate interests of citizens and the economy of the Republic of Kazakhstan from consequences of doubtful results of measurements.

 

State management of the activities to ensure traceability is done by the Committee for Technical Regulation and Metrology of the Ministry for Investment and Development of the Republic of Kazakhstan (CTRM).

 

The main objectives of ensuring the uniformity of measurements are:

1) to protect the interests of citizens and the economy of the Republic of Kazakhstan from consequences of doubtful results of measurements;

2) to ensure the safety and quality of domestic and imported products, processes (works) and services;

3) to ensure reliable accounting of all kinds of material and energy resources; 4) to ensure the reliability of measurements at basic researches and scientific developments;

5) to ensure reliable measurement results in the diagnosis and treatment of diseases, security monitoring working and living conditions of people, traffic safety and environmental protection.

 

State Metrology Service includes:

1) authorized body and its territorial divisions;

2) the state scientific metrological center, which provides the establishment, improvement, storage and application of the state standards of size units, creation of sizes transmission system of measurement units, developes regulations to ensure traceability, conducts comparison of measurement standards, and participates in the comparisons of results of verification and calibration of measurements, provides testing, metrological certification of measuring instruments, calibration measurement standards and high-precision measuring instruments, research and development, skills upgrading and retraining.

The authorized body shall perform the following functions:

- The formation and implementation of state policy on maintenance of unity of measurements;

- Establishment of rules of creation, approval, storage, use and comparisons of state measurement standards, improvement of the standard base of measurement units of the Republic of Kazakhstan;

- Organization of comparisons of the results of verification and calibration of measuring instruments;

- The establishment of the classification of the state standards of units used in the territory of the Republic of Kazakhstan;

- Determining the order of development and approval of standard documents on maintenance of unity of measurements;

- Definition of the general metrological requirements to means, methods and results of measurements, techniques of verification of measuring instruments;

- The organization of keeping the register of state for ensuring the uniformity of measurement systems;

- Organization and carrying out the state metrological control;

- Representation of the Republic of Kazakhstan in the international and regional organizations on metrology;

- The organization of training and retraining in the field of ensuring the uniformity of measurements frames.

The objectives of the RSE "KazInMetr" are testing of manufactured and imported measuring instruments in the Republic of Kazakhstan for compliance with the requirements, the improvement of technical (reference) base, harmonization of normative documents on metrology for ensuring the uniformity of measurements to international standards, training and skills development in the field of metrology, information support of individuals and legal entities for ensuring the uniformity of measurements.

 

The scope of state metrological control

State metrological control is applied to the measurement, the results of which are used for:

1) works to ensure the protection of life and health of citizens;

2) the implementation of activities in the field of environmental protection, geology and hydrometeorology;

3) implementation of the conformity assessment activities in accordance with the legislation of the Republic of Kazakhstan in the field of technical regulation;

4) government accounting operations, trade and commercial transactions between the buyer (consumer) and seller (supplier, producer, performer), including in the areas of household and utilities and communication services;

5) works to ensure the safety and traffic; 6) production of armaments and military equipment;

7) carrying out scientific research;

8) tests, metrological certification, verification, calibration of measuring instruments;

9) registration of national and international sports records;

10) extraction, production, processing, transportation, storage and consumption of all types of energy resources;

11) works carried out on behalf of the state authorities, court and law enforcement.

 

State metrological control of the release, commissioning, condition and application of measuring instruments (including reference materials of composition and properties of substances and materials), the use of performance measurement, standards of units of techniques, compliance with metrological rules and regulations made for the purpose of verifying compliance with the established metrological rules and regulations.

 

The objects of the state metrological control are:

1) standards of measurement units;

2) measuring instruments;

3) measurement techniques;

4) the activities of individuals and legal entities to ensure traceability in the observance of metrological rules and norms;

5) the number of packaged goods in packages of any kind at their packaging, sale and import;

6) the amount of the goods alienated at fulfillment of trading operations.

 

Type approval and metrological certification of measuring instruments

1. Measuring instruments, produced commercially in the Republic of Kazakhstan or imported into the territory of the Republic of Kazakhstan parties and intended for use in the field of state metrological control are subject to tests with the subsequent statement of type of measuring instruments before commissioning.

The decision on the type approval of measuring instruments made by the authorized body and makes sure the certificate of type approval of measuring instruments of the established sample which period of validity is established at its delivery.

2. The means of measurements made in the Republic of Kazakhstan or imported in individual copies and intended for use in the field of state metrological control, prior to commissioning are subject to metrological certification.

The decision on metrological certification of measuring instruments makes sure the certificate on metrological certification of measuring instruments of the established sample which period of validity is established at its delivery.

3. Tests of measurement for type approval and conformity to the approved type, metrological certification of means of measurements are carried out of the state metrological service.

Approved types of measuring instruments and measuring instruments that have passed metrological certification, shall be entered in the register of the state system for ensuring the uniformity of measurements.

4. Measuring instruments of approved type and (or) operational documents accompanying each copy, are to be marked by sign of a type approval of measuring instruments of the form established by the authorized body.

5. Information on the statement of type of measuring instruments and the decision to cancel of the approved type is published in the official publications of the authorized body.

6. The release into circulation, commissioning, use, sale and advertising of measuring instruments subject to state metrological control have not undergone testing for the purposes of type approval or metrological certification are prohibited.

 

Measuring instruments in service and in storage after expiry of the certificate of type approval, shall apply to full physical deterioration.

 

Verification of measuring instruments

 

Measuring instruments used in the implementation of the state metrological control are subjected to checking at release from manufacture or repair, operation and import on import after the approval of their type or metrological certification and registration in the register of the state system of ensuring the uniformity of measurements http://kazinmetr.kz/si/.

 

Verification is carried out by the state metrological service and metrological services of legal persons accredited for this activity.

 

The list and periodicity of verification of measuring instruments and the procedure for its implementation shall be determined by the authorized body.

 

The activity of the accredited legal entities is in accordance with the legislation of the Republic of Kazakhstan and normative documents to ensure traceability.

 

Legal entities accredited to the verification of measuring instruments shall maintain electronic records of data on calibrated measuring instruments and their transfer to the state scientific metrological center in the manner determined by the competent authority, except in cases constituting state secrets or other secrets protected by law.

 

Verification of measuring instruments is carried out by verification officers of the state metrological service or metrological services of the accredited legal entities in accordance with the procedure of verification of measuring instruments.

 

Certification of the verification officers is carried out every five years in order of the authorized body.

Legal metrology in Georgia

Georgian National Agency for Standards, Technical Regulations and Metrology is the responsible authority in the field of metrology in Georgia, both for standards and legal metrology. The Agency represents itself a legal entity of public law (LEPL) under the Ministry of Economy and Sustainable Development of Georgia.

The agency has the following functions:   maintenance of measurement standards and transfer of physical quantity units, type approval of measuring instruments, their registration, recognition of the primary verification, initial and periodic verification and calibration.

According to Georgian legislation, initial and periodic verification and calibration of the measuring instruments can be performed by the Agency and accredited bodies.

The legislative bases are the Georgian law “On the Provision of Measurement Unity” and sub normative regulation acts in the field of metrology (technical regulations).

According to Georgian Law “On the Provision of Measurement Unity” (chapter 2, article 6) there are the following legal measurement instruments in Georgia:

  1. Alcometers;
  2. Water flowmeters (flowmeters);
  3. Balances;
  4. Flowmeters used to measure liquids except water;
  5. Gas flowmeters (flowmeters);
  6. Meters of liquids level in vessels (tanks, containers and etc);

  9. Electricity meters;

10.  Instruments measuring luminous transmission of glass.

 

In 2011 the following works were performed:

Legal metrology in Kirgizia

Development and coordination of national policies and government regulation of the activities to ensure unity of measurements assigned to the Ministry of Economy and antitrust policy of the Kyrgyz Republic.

The goals of legal metrology is accomplished by establishing requirements formetrology regulations of Government of the Kyrghyz Republic.

Legal Metrology in Bosnia and Herzegovina

Institution representing and managing the metrology system in Bosnia and Herzegovina is Institute of Metrology of Bosnia and Herzegovina.

 

Institute of Metrology of Bosnia and Herzegovina (IMBIH) – representing National Metrology Institute in B&H is independent governmental institution directly responsible to the Council of Ministers of Bosnia and Herzegovina.

 

The metrology system of Bosnia and Herzegovina is regulated by Law on Metrology of B&H and Law on establishment of Institute of Metrology of B&H. Beside these two laws (also law on measuring units used in B&H) there are numerous bylaws regulating more detailed certain metrological areas and measuring instruments.

 

Institute of Metrology of Bosnia and Herzegovina is responsible for scientific, fundamental and legal metrology in B&H.

 

In Legal Metrology IMBiH is responsible for:

- Issuing the laws in Metrology area;

- Issuing of bylaws in accordance with the Law on Metrology;

- Supervision over the implementation of Law on Metrology;

- Type examination and type approval;

- Nomination of laboratories dealing with verification;

- Nomination of bodies for conformity assessment of MID and NAWI and other measuring instruments which are subject of legal metrology;

- Nomination of body for control of pre-package products.

 

The activities performed by nominated bodies (verification, conformity assessment and pre-packages) are under supervision of Institute of Metrology of Bosnia and Herzegovina.

 

The current institutional structure of the metrology system of B&H consists of:

- The Institute of Metrology of Bosnia and Herzegovina (IMBIH);

- The Entity Bureaus of Metrology: Bureau of Metrology of Federation of B&H and Republic Bureau of Standardization and Metrology of Republic of Srpska;

- Nominated metrological Laboratories and Bodies (verification laboratories);

Legal metrology in the Ukraine

A ministry of economic development and trade is responsible for the questions of legal metrology.

There are 4 National Institutes of Metrology (NMIs) in Ukraine: A national scientific center «Institute of metrology» (Kharkov) (www.metrology.kharkov.ua), State enterprise of Ukrmetrteststandart (Kiev) (of www.ukrcsm.kiev.ua), State enterprise the Research institute «Systema» (Lvov) (www.spr.ua), State enterprise «Ivano-Frankovskstandart-Metrologiya». The tasks of national institutes of metrology are creation of bases and transmission of the officially recognized units of measurement in the fixed kinds of measurements conduction of state tests of measuring instruments, verification of standards and other measuring instruments on the request of enterprises and organizations, including for authorized test laboratories and certified verification laboratories, certification of the methods conducting measurements in the fixed kinds of measurements and also providing consultations regarding legal and practical metrology,

 

In each area of Ukraine and in Crimea (26), and also in Belaya Tserkov and Sevastopol, there are created territorial authorities (only 28), besides that, their branches are created in many cities, - authorized for the verification of other measuring instruments, which are included into the sphere of distribution of state control and surveillance. The sphere of distribution of state control and surveillance is regulated by the Law of Ukraine «About metrology and metrology activity». The verification of measuring instruments is carried out in accordance with procedures of verification which become firmly established at pattern approval of measuring instruments or during the state metrological certification of concrete specimen of measurement instruments. Besides that, the certified verification laboratories can carry out a verification in the field of their authorization.

 

Legislation

  • Law of the Ukraine «About metrology and metrology activity».
  • Technical regulation on important requirements to measurement instruments, is developed in accordance with Directive 2004/22/EU of European Parliament and Council from March, 31 2004 on measurement instruments (MID). This technical regulation is approved by the Cabinet of Ministry of Economy to Ukraine and will be implemented since 2015.
  • Technical regulation on nonautomatic weighing devices, is developed in accordance with Directive of 2009/23/EU of European Parliament and Council from April, 23 2009 on nonautomatic weighing devices (NAWI). This technical regulation is approved by the Cabinet of Ministry of Ukraine and will be implemented since 2015.

The list of measuring instruments, and which are to be verified by state metrology structures, is not established; verification is carried out in accordance with the lists of measuring instruments, being in exploitation and which are to be a verified. These lists are to be made annually by enterprises and organizations in accordance with requirements of the Law of Ukraine «About metrology and metrology activity» and are agreed with bodies, carrying out the verification.

Legal metrology in Bulgaria

Organizations involved:

The Ministry of Energy, Economics and Tourism is in charge of legal Metrology.

 

Bulgaria’s national metrology institute (NMI) is the Bulgarian Institute of Metrology (BIM), see www.bim.government.bg. The BIM is responsible for maintenance of national measurement standards, traceability and dissemination of measurement units; carries out activities on realization of legal control of measuring instruments, control of gambling machines and fiscal devices, conformity assessment of non-automatic weighing instruments, calibration of some types of measuring instruments, and testing of products for electromagnetic compatibility.

 

Type approval of measuring instruments is performed by BIM in compliance with Directive 2009/34/EC, which is implemented in the national legislation

 

Type approval of measuring instruments with non-approved type is carried out at the stage of manufacturing or import in order to be allowed for verification.

 

The initial verification and the re-verification of measuring instruments are performed by BIM or by verification laboratories authorised by State Agency for Metrological and Technical Surveillance (SAMTS).

 

SAMTS  is responsible for:  supervision of manufacturers, importers, repairers and users of measuring instruments subject to control under the Law on Measurements; authorisation and surveillance of verification laboratories; market surveillance on measuring instruments under MID and NAWI; control of prepackages and MCB. These activities are performed by Directorate General “Metrological Supervision” (DG “MS”). DG “MS” is also responsible for: approval and surveillance of tachograph workshops under Council Regulation (EEC) No 3821/85; registration of repairers of fiscal devices; licensing of repairers of electronic taximeters with fiscal memory.

Legal metrology in Romania

Organizations involved:

The Romanian Bureau of Legal Metrology (www.brml.ro) is in charge with legal metrology.

BRML is a public institution with legal personality, subordinated to the Ministry of Economy.

Established by the Government Ordinance no. 20/1992 regarding the metrological activities, BRML is the specialized body of central public administration, responsible for the national coordination and supervision of legal metrological activities, assuring the metrological regulations and technical means needed to provide credibility to the measurement results throughout the country.

 

Upon regional level, BRML exercises its authority through 8 regional divisions of legal metrology (DRMLs) located in the cities of Bucharest, Bacau, Brasov, Cluj-Napoca, Constanta, Craiova, Ploiesti, Timisoara. The DRMLs are in charge with the verification of measuring instruments used in legal metrology applications and with the market supervision of measuring instruments. They also provide calibration services.

 

Subordinated to BRML is the National Institute of Metrology (www.inm.ro) which carries out scientific research activities, calibrations and type evaluation tests. It also provides verification services for certain measuring instruments. An important position in the organizational structure of BRML is occupied by the Division of Inspection and Market Surveillance (DISP) which performs inspection, random testing of the measuring instruments in use and market surveillance.

The measuring instruments subject to legal metrological control as well as the applicable control methods are indicated in the Official List approved by order of the BRML Director General. The Official List is updated periodically. The measuring instruments are subject to type approval, initial verification and mandatory re-verification.

 

The initial verification of the measuring instruments is performed in the laboratories of the 8 regional legal metrology divisions of BRML, in the INM laboratories or in other laboratories authorized by BRML.

 

The verification fees are indicated in the Tariffs List approved by government decision. This list is periodically updated.

 

A mandatory re-verification system operates through periodical verification and verification after repair / modification. These verifications are performed in the BRML laboratories or in laboratories authorized by BRML. The maximum verification intervals are indicated in the Official List approved by the Director General of BRML.

Subject of the Act

 

By this Act governed are:

a) the method for determination of technical requirements related to products which would endanger the health, safety or property of persons, or environment,

b) rights and obligations of legal entity entitled to carry out activities under this Act related to development, approval and issuance of Slovak technical standards,

c) procedures for conformity assessment of products to technical,

d) rights and obligations of enterprisers and other legal entities established according to specific regulation and designated to carry out activities under this Act related to conformity assessment.

e) the rights and obligations of enterprisers who manufacture, import or place the products on the market,

f) the competence of central body of state administration and other state administration bodies in the field of standardisation and conformity assessment.

g) surveillance over observance of the Act including infliction of fines.

Subject of the Law:

This Law, with the purpose of ensuring the uniformity and correctness of measurement, stipulates:

a) legal units of measurement,

b) requirements for measuring instruments and their metrological control,

c) conditions for official measurement,

d) requirements for pre-packaged products,

e) conditions for authorization and registration,

f) competence of state administration bodies in the field of metrology,

g) metrological supervision,

h) infliction of fines.

 

Classification of measuring instruments:

a) national standard and other standards,

b) certified reference materials and other reference materials,

c) legally controlled measuring instruments.


Legal measuring instruments:

(1) Legal measuring instruments are measuring instruments determined for mandatory metrological control or conformity assessment.

(2) Decisive for including a measuring instrument into the category of legal measuring instruments is the purpose of its use and its use:

a) at measurements related to payments,

b) at the protection of health, safety, property and environment,

c) at the preparation of pre-packaged products,

d) in other areas of public life where conflict interests in the result of measurement can arise or where incorrect results of measurement can harm the interests of individuals, legal entities or the interests of the society,

e) at measurements, if so stipulated by specific regulation.

 

Metrological control:

Metrological control is carried out:

a) before placing legal measuring instruments on the market,

b) during the use of legal measuring instruments.

 

1) Metrological control before placing legal measuring instruments on the market is:

a) the type approval of legal measuring instruments

1. national type approval or

2. European Communities type approval,

b) the initial verification of legal measuring instruments

(Initial verification means verification of a new measuring instrument or of a measuring instrument after repair.)

1. national initial verification or

2. European Communities initial verification.

 

(2) Metrological control during the use of legal measuring instruments:

 

Subsequent verification

(Subsequent verification is every verification following after the initial verification. )

 

Authorisation

Authorisation under this Law means granting the license to the entrepreneur or to other legal entity to perform the verification of legal measuring instruments or to carry out official measurements.

 

Registration

The entrepreneur the subject of whose activity is the repair or assembly of legal measuring instruments or packing or import of marked pre-packages.

 

State administration bodies in the field of metrology

a) Slovak Office of Standards, Metrology and Testing is the central body of state administration in       the field of metrology

b) Slovak Institute of Metrology is the  national metrology institution,

c) Slovak Metrology Inspectorate is the body of metrological supervision

Legal Metrology in the Republic of Tajikistan

 

The legislation of the Republic of Tajikistan about ensuring the uniformity of measurements in the Republic of Tajikistan is based on the Constitution of the Republic of Tajikistan and consists of the Law «About ensuring the uniformity of measurements», other normative legal acts of the Republic of Tajikistan and international legal acts recognized by the Republic of Tajikistan.

 

The authorized body of the Government of the Republic of Tajikistan for ensuring the uniformity of measurements is the Agency for Standardization, Metrology, Certification and Trade Inspection under the Government of the Republic of Tajikistan.

 

The competence of Tajikstandart includes:

- interregional and inter-sectoral coordination of activities for ensure the uniformity of measurements;

- establishment of rules for the creation, approval, storage and use of state measurement standards of units of quantities;

- approval of normative documents for ensuring the uniformity of measurements that establish metrological rules and norms subject to mandatory application in the territory of the Republic of Tajikistan;

- definition of the general metrological requirements to the measurement instruments, methods and results of measurements;

- realization of state metrological inspection and supervision;

- management of the state metrological service and other metrological services for ensure the uniformity of measurements;

- participation in the activities of international organizations on the issues of ensuring the uniformity of measurements.

 

The metrological service of the Republic of Tajikistan consists of the state metrological service and metrological services of legal entities.

The state metrological service, headed by the authorized body of the Government of the Republic of Tajikistan, includes the bodies of the state metrological service in the Gorno-Badakhshan Autonomous Region, the regions of the republic, the districts of the republican subordination and the city of Dushanbe.

 

State management bodies of the Republic of Tajikistan, as well as factories, organizations, institutions that are legal entities, create metrological services in the required case in the established order to execution work to ensure uniformity and the required accuracy of measurements and to execute metrological inspection and supervision.

 

The rights and responsibilities of metrological services are determined by the provision approved by the bodies of the state metrological service in the case established by the authorized body of the Government of the Republic of Tajikistan.

 

Legislation

The Law of the Republic of Tajikistan «About ensuring the uniformity of measurements» was adopted on 15.05.1997. Changes and additions of the Law were made in 2002, 2007 and 2008 years.

 

In recent years, three normative documents in the field of metrology have been developed and approved in the Ministry of Justice of the Republic of Tajikistan («Procedure for Recognizing and Type Approving of Measuring Instruments» (ПР 50.2.009)), «Procedure for Execution Verification of Measuring Instruments» (ПР.50.04.07)) and «The procedure for inspecting the activities of economic entities in the Republic of Tajikistan by the authorized body for standardization, metrology, certification and trade inspection».

 

According to the Decree of the Government of the Republic of Tajikistan of 2 October 2012, № 512, the State Program «Quality for 2013-2015» was adopted. In order to implement this Program, a plan-event was developed, according to which it is planned to equip metrological laboratories with new modern high-accuracy measurement instruments, the creation of new metrological laboratories of mass and temperature, and the harmonization of national standards with international and European standards.

Legal metrology in Uzbekistan

Participating organizations:

The Uzbekistan Agency for Standardization, Metrology and Certification («Uzstandard» Agency) is responsible for legal metrology issues, see www.standart.uz.

 

The National Institutes of Metrology (NMI) are:

- State Enterprise «Centre of Metrological Services»;

- State Enterprise «Centre of National Standards of Republic of Uzbekistan»;

- Scientific Research Institute of Standardisation, Metrology and Certification.

 

The tasks of the Agency «Uzstandard» are:

- implementation of a unified state policy in the field of metrology, interregional and inter-industry coordination of metrological activities;

- setting of rules for the creation, approval, storage and maintenance of national standards and ensuring their comparison at the international level;

- definition of the general metrological requirements to the measuring instruments, methods and results of measurements;

- implementation of state metrological control and supervision;

- training of scientific and engineering staff in the field of metrology;

- control for compliance with international agreements of the Republic of Uzbekistan in the field of metrology;

- implementation of activities to protect consumers rights, health and safety of citizens, the environment and state interests against the negative effects of unreliable measurement results.

 

In Uzbekistan, accredited metrological services (authorized bodies) for verification of the measuring instruments are responsible for verification the measuring instruments that located into the list of measuring instruments subject to state verification and supervision. The accredited metrological services (authorized bodies) are SE «Centre of Metrological Services», SE «Centre of National Standards of Republic of Uzbekistan», Scientific Research Institute of Standardisation, Metrology and Certification and 17 territorial Centers for testing and certification.

By order of Agency «Uzstandart» dated 17.12.1992 No. 90, Scientific Research Institute of Standardisation, Metrology and Certification is entrusted with the functions of the Main Center of Metrological Service and the Main Center of Standard Samples of the Republic of Uzbekistan and by the order of the Agency «Uzstandart» dated February 9, 1999, No. 6, the functions of the Main Center for Nondestructive Testing of the Republic of Uzbekistan.

Legal metrology in Cuba

The National Bureau of Standards is the Central Metrology Authority and establishes regulations on metrology in Cuba and directs the National Metrology Service (SENAMET).

 

The main tasks and activities of the SENAMET are:

- In the field of legal metrology: 

Regulates and implements control activities and supervision of measuring instruments on behalf of the State, in order to monitor its correct application and measurement accuracy involved.

 

- In the field of scientific metrology:

Establish and maintain national standards of legal units of measurement and ensure traceability to international standards and carry the work related to the recognition of calibration and measurement capabilities (CMC) of Cuba.

 

- In the field of industrial metrology:

Organizes and supervises chains calibration to ensure traceability of measurements.

 

The SENAMET which is composed by:

1) Division of Metrology of NC (CMA);

2) The National Research Institute of Metrology (INIMET) subordinate to NC, as NMI of Cuba, running the scientific and research work in the fields of metrology;

3) Designated institutes of other branches of the economy, running the scientific and research work in the specific fields of metrology. At present there are two institutes designated in the field of ionizing radiation: Isotopes Center (CENTIS) and Center for Hygiene and Protection Radiation (CPHR);

4) Territorial Metrology Centers and Provincial Laboratories of Metrology are the Local Metrology Authorities (LMA), included in the Territorial’s Bureaus of Standards (TBS) subordinate to NC, running the activities of the National Service of Metrology in the territory of their competence;

5) Laboratories registered and accredited of testing and calibration of the enterprises, agencies and other forms of production and service;

6) Metrological Supervisory authorities (inspectors), that they are part of the TBS.

 

The legal basis covering metrology in Cuba is composed of:

Decree Law No 183/1998 of Metrology.

 

Decree No 270/2001 Regulation of Decree Law 183.

 

Decree Law No 62/1982 on the implementation of the International System of Units (SI) Several General Provisions of the National Bureau of Standards, including the most important:

- DG 01: 2014- measuring instruments subject to mandatory verification and type approval according to the application fields where they will be used;

- DG 10: 2014- Policy metrological traceability.

 

The evaluation of models of instruments and measurement systems is done by the INIMET and Territorial Metrology Centers of the provinces of Villa Clara and Holguin.

 

The type approval is responsibility of the Director of Metrology of the National Bureau of Standards. For it has formed a Commission of Approval. This Commission is responsible to homologate the basic certificate of approval issued by authorized foreign institutions. The MAA certificates are accepted.

 

The SENAMET laboratories run the verification of measuring instruments and test of pre-packaged products.

 

The SENAMET inspectors perform the metrological supervision.

 

The instruments and measurement systems subject to metrology control:

- radar equipment for measuring the speed of vehicles;

- alcoholmeters.

 

Cuba is full member of the OIML and associate member of CGPM. It is a signatory to the Mutual Recognition Agreement CIML since the year 2001. Is associate member of COOMET.

 

The calibration of measuring instruments is performed by SENAMET and more than 170 calibration laboratories, established in the framework of industry or other organisations. Of these laboratories, 31 are accredited to different extents by the National Accreditation Body (ONARC). All these laboratories are subject to metrological supervision.

 

The ONARC is a full member of the Inter-American Accreditation Cooperation (IAAC) and the International Laboratory Accreditation Cooperation (ILAC). It is a signatory member of the Mutual Recognition Arrangement of ILAC and IAAC since 2005.
