Legal Metrology in Kazakhstan

Law of the Republic of Kazakhstan of 7 June 2000 No. 53-II “On Ensuring the Uniformity of Measurements” (in view of a new version of the Law of the Republic of Kazakhstan of 5 October 2018 No. 184-VІ “On making Amendments and Additions to Some Legal Acts of the Republic of Kazakhstan Related to Ensuring the Uniformity of Measurements and Standardization”)

Organizational structure in LM

1. The Committee of Technical Regulation and Metrology of the Republic of Kazakhstan (Gosstandart) is an authority of the Ministry of Trade and Integration of the Republic of Kazakhstan (hereinafter referred to as the Ministry), which performs regulatory, implementation and control functions and is also involved in the fulfillment of strategic functions of the Ministry in the fields of technical regulation, standardization and ensuring the uniformity of measurements, legislation of the Republic of Kazakhstan on accreditation in the field of conformity assessment. The functions of Gosstandart are:

1. to organize the maintenance of the register of the state technical regulation system;

2. to ensure the organization of works on interlaboratory comparative tests (comparisons);

3. to approve state measurement standards of units;

4. to organize scientific research in the field of metrology;

5. to organize and carry out state metrological control;

6. to approve a type of measuring instruments, reference materials;

7. to carry out state control in the fields of:

    a. technical regulation;

    b. ensuring the uniformity of measurements;

    c.  legislation of the Republic of Kazakhstan on accreditation in the field of conformity assessment;

8. to perform interregional and inter-industry coordination and works aimed at ensuring the uniformity of measurements of time and frequency and determining the Earth rotation parameters;

9. to perform interregional and inter-industry coordination and works, related to the development and implementation of reference materials;

10. to perform interregional and inter-industry coordination and works, related to the development and implementation of standard reference data on physical constants and properties of substances and materials;

11. to organize the analysis and preparation of national standards (except for military national standards) and interstate standards;

12. to register national standards (except for military national standards), national classification of technical and economic information and recommendations on standardization;

13. to adopt national standards (except for military national standards), national classification of technical and economic information and recommendations on standardization, as well as amendments to them;

14. to perform coordination of activities of the state scientific metrological center;

15. to approve the classification of measurement standards of units;

16. to approve and register measurement procedures and reference measurement procedures in the Register of the state system of ensuring the uniformity of measurements.

 

2. The state metrology service is established by Gosstandart and includes the national metrology institute (NMI) and bodies, authorized by it for performing works on metrological test in LM.

 

3. Kazakhstan Institute of Metrology (KazInMetr) was appointed as the NMI and is responsible for: 

1. conduct of scientific research in the field of ensuring the uniformity of measurements;

2. carrying out of comparisons of the results of verification, calibration of measuring instruments and interlaboratory comparative tests;

3. performance of works on advanced training and retraining in the field of ensuring the uniformity of measurements;

4. creation, improvement, maintenance and application of state measurement standards of units;

5. creation of unit dissemination systems;

6. preparation of documents on standardization in the field of ensuring the uniformity of measurements, measurement procedures, verification and calibration procedures for measuring instruments;

7. production and repair of measuring instruments;

8. production of reference materials, certified mixtures, verification gas mixtures;

9. carrying out of verification and calibration of measuring instruments;

10. carrying out of metrological certification of measurement procedures;

11. carrying out of metrological examination;

12. carrying out and participation in comparisons of measurement standards of units;

13. testing of measuring instruments for type approval, carrying out of metrological certification of measuring instruments, certification of testing equipment;

14. maintenance of the register of the state system of ensuring the uniformity of measurements;

15. certification, recertification and withdrawal of certificates of measuring instruments verification officers;

16. organization of verification marks production;

17. approbation of measuring instruments verification procedures;

18. performance of works on ensuring the uniformity of measurements of time and frequency, determination of Earth rotation parameters;

19. performance of works, related to the development and implementation of standard reference data on physical constants and properties of substances and materials;

20. exercise of other authorities, established under the legislation of the Republic of Kazakhstan.

Units

The units of the International System of Units (SI) are applied in the Republic of Kazakhstan.  

Law on metrology

Law of the Republic of Kazakhstan of 7 June 2000 No. 53-II “On Ensuring the Uniformity of Measurements” (in view of a new version of the Law of the Republic of Kazakhstan of 5 October 2018 No. 184-VІ “On making Amendments and Additions to Some Legal Acts of the Republic of Kazakhstan Related to Ensuring the Uniformity of Measurements and Standardization”).

List of MIs within the field of Legal Metrology or scope of state regulation

1. Currently the scope of state metrological control is determined by the lists of measurements, relating to state regulation, approved by specialized public authorities in consultation with the state authorized body in the field of technical regulation and metrology. To date 10 lists of measurements in such fields as health care, defense, agriculture, finance, industry, aerospace industry, ecology, energetics have been adopted.

 

2. Objects of state metrological control are:

    1. national measurement standards of units;

    2. measurement standards of units and measuring instruments of accreditation entities;

    3. measuring instruments;

    4. reference materials;

    5. normative legal acts, technical regulations;

    6. measurement procedures.

 

3. MIs, which are objects of state metrological control after their type approval or metrological certification and registration in the register of state MIs of the RK prior to release, after repair, in the process of their service, are subject to verification.         

    MIs, which are not subject to type approval and verification, should undergo calibration on a voluntary basis.

 

4. Verification of measuring instruments is performed by certified verification officers of accredited legal entities. Calibration of measuring instruments shall be carried out in accordance with the procedure, established by the manufacturer, owner or user of measuring instruments.

Type approval

1. Legal and technical requirements for type approval

    1. Requirements for type approval (TA) are set in a  normative legal act (“On adopting the Rules for type approval, testing for type approval, metrological certification of measuring instruments, form of the certificate of type approval for measuring instruments and establishing the form of a type approval mark” of 27 December 2018 No.931).  

    2. Measuring instruments, which are objects of state metrological control, are subject to type approval before their release.

    3. The authorized body makes a decision on the type approval of measuring instruments based on the successful testing for type approval of measuring instruments, certified by a certificate of type approval of the measuring instruments.

 

2. Bodies, responsible for type approval The authorized body makes decisions on type approval of MIs and issue of certificates of type approval of MIs.

 

3. Bodies, responsible for testing for type approval Testing for type approval, type approval of a batch and metrological certification of measuring instruments shall be performed by the state scientific metrological center.

 

4. Recognition of OIML certificates Kazakhstan is a full OIML member. Currently Kazakhstan does not take part in the OIML Certification System.

Verification

1. Legal and technical requirements for initial and periodic verification Requirements for verification arrangements are set in a normative legal act (“On adopting the Rules for verification of measuring instruments, defining the frequency of verification of measuring instruments and establishing the form of the certificate of verification of measuring instruments” of 27 December 2018 No 934).

   1. In verification of measuring instruments the traceability of measurement standards used for verification, verified measuring instruments to national measurement standards of the Republic of Kazakhstan is ensured according to the Rules for ensuring the traceability of measurements for accreditation entities and legal entities during accreditation, or in their absence to national measurement standards of other states, the degree of equivalence of which is acknowledged in the database of key comparisons of the International Bureau of weights and Measures. 

   2. Measuring instruments, which are objects of state metrological control, are subject to verification after their type approval or metrological certification and registration in the register of the state system of ensuring the uniformity of measurements, prior to release, after repair, in the process of their service.   

   3. Satisfactory results of the verification of measuring instruments shall be certified by applying a verification mark to the MI, and (or) to the corresponding section of the operating documentation or to a certificate of verification, and by the issue of the certificate of verification of the measuring instruments.

 

2. Bodies for verification Verification of measuring instruments shall be performed by certified verification officers of accredited legal entities in accordance with the procedure for verification of measuring instruments.

 

3. RVIs for categories of MIs

  1. Requirements for verification arrangements are set in a normative legal act (“On adopting the Rules for verification of measuring instruments, defining the frequency of verification of measuring instruments and establishing the form of the certificate of verification of measuring instruments” of 27 December 2018 No. 934).

  2. In determining the frequency of verification for a group of measuring instruments of the same type a single interval between verifications (reverification interval) is set for all measuring instruments of the group. A single reverification interval is set in accordance with ST RK 2.44 “State system of ensuring the uniformity of measurements of the Republic of Kazakhstan. Determination of reverification intervals of working measuring instruments”. 

  3. In the Republic of Kazakhstan the following RVIs (years) are currently valid for the following categories of MIs:

4. Other national requirements for verification  

Legal entities, accredited for verification of measuring instruments, shall implement electronic maintenance of records on verifiable measuring instruments and their transfer to the state scientific metrological center in accordance with the procedure, established by the authorized body, except in cases of state secrets and other legally protected secrets.

Prepackages

1. Legal requirements for controlling prepackages

Amendments are being made to the existing law “On making Amendments and Additions to Some Legal Acts of the Republic of Kazakhstan Related to Technical Regulation” in terms of extending the competence of the authorized body in respect to approving the procedure for determination of compliance of the product quantity in packages of any kind during prepackaging, sale and import, and of the quantity of product, expropriated in trade operations.

 

2. Documents, setting requirements for prepackages

As part of amendments made to the Law “On Ensuring the Uniformity of Measurements” a normative legal act is being prepared for approving the procedure for determination of compliance of the product quantity in packages of any kind during prepackaging, sale and import, and of the quantity of product, expropriated in trade operations.

 

3. Bodies, involved in control of prepackages

Authorized bodies in the field of technical regulation and metrology are responsible for conducting state metrological supervision of compliance with requirements for prepackages.

 

4. Other national requirements for prepackages

 -

Metrological supervision

1. State metrological supervision shall be conducted by the authorized body and its territorial subdivisions in order to verify the compliance with the legal requirements of the Republic of Kazakhstan on ensuring the uniformity of measurements by natural persons and legal entities.

 

2. State metrological supervision shall be conducted by officials of the authorized body and its territorial subdivisions in accordance with the laws of the Republic of Kazakhstan.      The officials, conducting state metrological supervision, include:

   1. Chief State Inspector for state supervision of the Republic of Kazakhstan– Head of the authorized body;

   2. Deputy Chief State Inspectors for state supervision of the Republic of Kazakhstan -  Deputy Heads of the authorized body;

   3. Chief State Inspectors for state supervision of regions, cities of republican status, capital – Heads of territorial subdivisions;

   4. Deputy Chief State Inspectors for state supervision of regions, cities of republican status, capital, cities and towns – Deputy Heads of territorial subdivisions and Heads of their structural subdivisions;

   5. State Inspectors for state supervision of regions, cities of republican status, capital, cities and towns – experts of territorial subdivisions on state supervision.

 

2. The officials, conducting state metrological supervision, shall undergo mandatory certification in accordance with the procedure, established by the legislation of the Republic of Kazakhstan, for the purpose of determining suitability for their positions and assessing their professional skills.

 

3. Entities, to which state metrological supervision applies, are organizations, their separate subdivisions, having a payer’s identification number, representative offices of foreign organizations, SPs and other entities defined by the President of the Republic of Kazakhstan, involved in relations in the field of ensuring the uniformity of measurements, regulated by the legislation on ensuring the uniformity of measurements.

Legal metrology practitioners

Verification of measuring instruments is performed by certified verification officers of accredited legal entities.

Sanctions

Code of Administrative Offences of the Republic of Kazakhstan of 5 July 2014 No. 235-V (as amended and supplemented as of 12.06.2020)

Article 419 Violation of the legislation of the Republic of Kazakhstan on ensuring the uniformity of measurements

 

1. Violation of the legislation of the Republic of Kazakhstan on ensuring the uniformity of measurements, committed in the form of:

    - violation of mandatory metrological requirements for measurements, measuring instruments, reference materials, measurement procedures, set in the lists of measurements related to state regulation, and in normative legal acts;

    - release, use of measuring instruments, subject to state metrological control, which did not undergo tests for type approval or metrological certification, as well as verification and (or) which are not included in the register of the state system of ensuring the uniformity of measurements;

    - application of measurement procedures, subject to state metrological control, which didn’t undergo metrological certification and registration in the register of the state system of ensuring the uniformity of measurements, -

    shall result in imposition of a fine of 30 monthly notional units for natural persons, up to 230 monthly notional units for officials, small business entities or non-profit organizations, of 310 monthly notional units for medium-sized business entities, of 1600 monthly notional units for  large business entities.

 

2. Action (inaction), envisaged in the first part of the article, committed repeatedly within a year after the imposition of the administrative penalty, -

    shall result in imposition of a fine of 90 monthly notional units for natural persons, of 460 monthly notional units for officials, small business entities or non-profit organizations, of 620 monthly notional units for medium-sized business entities, of 2000 monthly notional units for  large business entities.
