Legal Metrology in the Republic of Tajikistan

Organizational structure in LM

1. Structure of the metrology service of the Republic of Tajikistan The metrology service of the Republic of Tajikistan consists of the state metrology service and metrology services of legal bodies.

2. State metrology service The state metrology service, headed by the authorized body of the Government of the Republic of Tajikistan, includes bodies of the state metrology service in Gorno-Badakhshan autonomous region, regions, Dushanbe city, centrally administered cities and districts (LRT No 467, 31.12.2008).

3. Metrology services of legal bodies Legal bodies can establish metrology services within their structures to ensure the uniformity of measurements. The rights and obligations of the metrology services of legal entities are determined by the Regulations of the state metrology service, approved by the Government of the Republic of Tajikistan (LRT No 467, 31.12.2008).

Units

The units of the International System of Units (SI) can be used in the Republic of Tajikistan as appropriate.

Names, designations of units and spelling rules, as well as rules for their application in the Republic of Tajikistan are specified by the Government of the Republic of Tajikistan, except in cases provided for in legal acts.

The Government of the Republic of Tajikistan can also allow to use off-system units along with the units of the International Measurement System.

Characteristics and parameters of exported products, including measuring instruments, can be expressed in units, specified by the customer.

It is prohibited to use units, different from officially allowed units, except in cases, specified by the Government of the Republic of Tajikistan (LRT No. 467, 31.12.2008).

Law on metrology

Law of the Republic of Tajikistan “On Ensuring the Uniformity of Measurements” (Akhbori of Majlisi Oli of the Republic of Tajikistan, 1997, No. 10, art.131; 2002 No. 4, part 1, art. 224; 2007 No. 7, art. 683; 2008 No. 12,  part 2, art. 1001).

List of MIs within the field of Legal Metrology or scope of state regulation

Normative documents on ensuring the uniformity of measurements are binding in the territory of the Republic of Tajikistan.

State metrological control and supervision, conducted to verify the compliance with metrological rules and provisions, apply to: ­ 

- health care, veterinary medicine, environmental protection, occupational safety;

- trading operations and mutual payments between the buyer and seller, including those for operation using slot machines and devices;   ­ 

- state accounting operations; ­  

- insurance of national defense; ­ 

- geodetic and hydrometeorological works; ­ 

- banking, fiscal and postal operations; ­ 

- manufacture of products, supplied under contracts for state needs in accordance with the law of the Republic of Tajikistan; ­ 

- testing and control of products quality to determine whether they conform to mandatory requirements of national standards of the Republic of Tajikistan; ­  mandatory certification of products and services; ­ 

- measurements, performed at the instruction of the court, public prosecution office, economic court, public administration of the Republic of Tajikistan; 

- registration of national and international sports records.

Normative acts of the Republic of Tajikistan can extend state metrological control and supervision to other areas of activity.

Type approval

In the areas where state metrological control and supervision are extended, measuring instruments are subject to mandatory testing with the subsequent approval of the type of measuring instruments. The authorized body of the Government of the Republic of Tajikistan shall make a decision on the approval of the type of measuring instruments and certify it with a certificate of type approval for the measuring instruments. The validity of this certificate shall be defined by the authorized body of the Government of the Republic of Tajikistan at the time of its issue.

The approved type of measuring instruments shall be added to the State Register of measuring instruments, maintained by the authorized body of the Government of the Republic of Tajikistan.

The authorized body of the Government of the Republic of Tajikistan performs testing of measuring instruments for approval of their type.

Other specialized organizations can be accredited as state testing centers for measuring instruments by the decision of the authorized body of the Government of the Republic of Tajikistan.

In order to perform tests specimens of measuring instruments, accompanied by relevant normative and operational documents, shall be submitted in accordance with the procedure, established by the authorized body of the Government of the Republic of Tajikistan.

The conformity of measuring instruments to the approved type in the territory of the Republic of Tajikistan shall be controlled by the bodies of state metrology service by the location of manufacturers or users.

A type approval mark of a due form shall be affixed to measuring instruments of the approved type and to operational documents, accompanying each specimen.

Verification

Measuring instruments, subject to state control in production, repair and operation, shall be verified by the bodies of state metrology service to confirm that they comply with the established normative legal acts of the Republic of Tajikistan.

The list of measuring instruments subject to verification and the procedure of verification of conformity shall be defined by the authorized body.

With the permission of the authorized body metrology services of other legal entities can be accredited to perform activities in the field of verification of conformity of measuring instruments.

The accreditation procedure for metrology services of legal entities shall be established by the Government of the Republic of Tajikistan.

Measuring instruments, verified for compliance according to the procedure established by the authorized body, are identified by a stamp or by a certificate of verification (LRT No. 467, 31.12.2008).

Metrological supervision

State metrological supervision and control shall be conducted by the state metrology services of the authorized body.

 

State metrological supervision and control shall be conducted as follows:

- approval of the type of measuring instruments; ­  

- verification of measuring instruments; ­  

- verification of application of recommended measurement methods; ­  

- verification of compliance with metrological provisions and rules;

- other types of metrological control, specified by the law of the Republic of Tajikistan (LRT No. 467, 31.12.2008).

Legal metrology practitioners

Verification in legal metrology shall be performed by state verification officers, who underwent the obligatory certification for conformity of the staff's competence in accordance with PR 50.2.006-2010 “Procedure for certification of measuring instruments verification officers”.

The total number of experts of the Republic of Tajikistan, involved in testing for type approval of MIs, metrological examination, and verification of MIs in LM, amounts to about 130.

Sanctions

Code of Administrative Offences of the Republic of Tajikistan of 31 December 2008 No. 455:

Article 629. Release of measuring instruments without type approval or without metrological verification (certification).

1. Release of measuring instruments without type approval or without metrological verification (certification) shall result in imposition of a fine of 10 to 15 estimate indicators for individuals, 40 to 50 estimate indicators for legal entities, 100 to 200 estimate indicators with confiscation of property of administrative offence.
