Legal metrology in the Kyrgyz Republic

(in view of the amendments to the Law of the Kyrgyz Republic "On Ensuring the Uniformity of Measurements" as of March 4, 2020 No. 23.

Organizational structure in LM

1. The Ministry of Economy of the Kyrgyz Republic, the state body for ensuring the uniformity of measurements, develops and coordinates the implementation of a unified state policy in the field of ensuring the uniformity of measurements, authorizes legal entities to conduct tests for type approval and verification of measuring instruments.

 

2. Center for Standardization and Metrology is the national metrology body, having the following functions:

- carrying out of works to ensure the conformity of the measurement system to the International System of Units (SI) to strengthen the role of measurements and standards in the development of the economy of the Republic;

- maintenance and improvement of national measurement standards of units of quantities, reproduction and transmission of basic and derived units of quantities of the International System of Units (SI);

- rendering of metrological services to business entities for verification, calibration, type approval of measuring instruments;

- approval of reference materials;

- maintenance of a state register of measuring instruments and reference materials;

- carrying out of work on the recognition of the results of metrological works in accordance with international treaties that have entered into force according to the procedure prescribed by the law, to which the Kyrgyz Republic is a party;

- participation in the comparison of standards at the international, regional and national levels to ensure international recognition of national measurement standards and calibration and measurement certificates;

- participation in the provision and revocation of the right to test measuring instruments or certify reference materials for type approval or verification of measuring instruments;

- implementation of research work in the field of metrology;

- exchange of information in the field of ensuring the uniformity of measurements with international metrological organizations and national metrology bodies of other countries.

Territorial subdivisions of the Center for Standardization and Metrology:

- rendering of metrological services to business entities for verification, calibration of measuring instruments.  

 

3. The State Inspectorate for Environmental and Technical Safety under the Government of the Kyrgyz Republic, the state body for metrological supervision, exercises state supervision and control of ensuring the compliance with safety standards for life and health of people, flora and fauna, environment and prevention of negative effects.

 

4. Мetrology services of legal entities to ensure the uniformity of measurements.

The units of the International System of Units (SI) are applied in the Kyrgyz Republic.

Law on metrology

List of MIs within the field of legal metrology or scope of state regulation

1. The scope of state regulation extends to measurements that are performed in:

- carrying out activities in the field of healthcare, veterinary medicine;

- carrying out activities in the field of environmental protection, ensuring traffic safety;

- performing works to ensure safe conditions and labor protection;

- implementing trade operations and mutual settlements between the manufacturer (seller) and the consumer (buyer);

- rendering postal services and accounting for the volume of telecommunication services rendered (connection duration and traffic volume);

- carrying out activities within the mandatory scope of technical regulation.

 

2. Measuring instruments made in the Kyrgyz Republic or imported into the territory of the Kyrgyz Republic intended for use within the scope of state regulation shall be subject to type approval by the national metrology body before their release.

 

3. Measuring instruments made in the Kyrgyz Republic or imported into the Kyrgyz Republic in single copies or in small batches in the amount of not more than 10 units intended for use within the scope of state regulation shall be subject to registration by the national metrology body before their release.

Type approval

1. Legal and technical requirements for type approval

Measuring instruments made in the Kyrgyz Republic or imported into the territory of the Kyrgyz Republic and intended for use within the scope of state regulation are subject to type approval by the national metrology body - CSM under the Ministry of economy of the Kyrgyz Republic - before their release.

The type approval of measuring instruments (MIs) or reference material (RMs) is carried out on the basis of positive test results or metrological examination in order to approve the type of MI or RM.

2. Bodies, responsible for type approval

Decisions on the type approval of MIs and RMs are made by the national metrology body.

 

3. Bodies, responsible for testing for type approval

Tests are conducted in the laboratories of the CSM and the Bishkek Center of Testing and Certification and other territorial subdivisions.

 

4. Recognition of OIML certificates

The Kyrgyz Republic is an associate member of the OIML. The Kyrgyz Republic is not involved in the OIML Certification System.

Verification

1. Legal and technical requirements for initial and periodic verification

The procedure for verification of MIs was approved by the Decree of the Government of the Kyrgyz Republic "On measures to implement the Law of the Kyrgyz Republic" On ensuring the uniformity of measurements" of September 2, 2019 No. 446 (this is a new version).

Reverification intervals for MIs are set upon their type approval. The results of verification are certified by a certificate of verification and (or) application of a mark to the MI or, in the absence of such an opportunity, of a verification mark to its operational documentation.

 

2. Bodies for verification

2.1 Verification is carried out by the territorial subdivisions of national metrology body.

2.2 Those, authorized by the Ministry of Economy of the Kyrgyz Republic to carry out state verification, from among legal entities, accredited in accordance with the rules of accreditation for verification.

2.3 Verifiers must be certified.

 

3 RVIs

3.1 The general list of MIs subject to mandatory verification is given in the Decree of the Government of the Kyrgyz Republic "On measures to implement the Law of the Kyrgyz Republic "On ensuring the uniformity of measurements" of September 2, 2019 No. 446 (this is a new version).

3.2 In the Kyrgyz Republic the following RVIs (years) are currently valid for the MIs:

This Decree of the Government of the Kyrgyz Republic is amended annually, or once every two years.

 

4. Other national requirements for verification

The state body in the field of ensuring the uniformity of measurements - the Ministry of Economy of the Kyrgyz Republic - makes a decision as appropriate on authorizing legal entities to conduct verification of MIs, provided that the national metrology body and its territorial subdivisions do not have a measurement standard in this area.

The conformity assessment of MIs is carried out for compliance with the requirements of the applicable technical regulations of the Customs Union (TR TS 004, TR TS 020, TR TS 012).

Prepackages

1. Legal requirements for controlling prepackages

In the Kyrgyz Republic state regulation applies to measurements in determining mass, volume, length, area or other quantities indicating the amount of goods contained in a package.

Requirements for the procedure for conducting metrological supervision are established by the Government of the Kyrgyz Republic.

 

2. Documents, setting requirements for prepackages

- The Decree of the Government of the Kyrgyz Republic of May 31, 2012 No. 350 approved the Regulation on the procedure for conducting state metrological supervision, according to which metrological supervision is conducted.

- GOST 8.579-2002 "State system for ensuring the uniformity of measurements (GSI). Requirements for the quantity of goods in prepackages of any kind during their production, prepackaging, sale and import".

- KMS 8.006-2002 "National system for ensuring the uniformity of measurements of the Kyrgyz Republic. The procedure for the implementation of metrological control of the quantity of goods in prepackages of any kind during their packaging, sale. General requirements".

 

3. Bodies, involved in control of prepackages

In the Kyrgyz Republic metrological supervision is conducted by the State Inspectorate for Environmental and Technical Safety under the Government of the Kyrgyz Republic (hereinafter SIETS).

 

4. Other national requirements for prepackages

Metrological supervision

1. State metrological supervision (SMS) is conducted by the State Inspectorate for Environmental and Technical Safety under the Government of the Kyrgyz Republic in the form of scheduled, unscheduled, control inspections and cross-checks.

Scheduled inspections are performed in accordance with strategic plans, as well as inspection plans. A strategic plan is formed for a year and includes quantitative indicators for each area. A strategic plan is agreed with the authorized body for entrepreneurship development (Ministry of Economy of the Kyrgyz Republic).

Based on strategic plans, annual or quarterly inspection plans are formed, which are agreed with the authorized body for entrepreneurship development.

 

2. State metrological supervision (SMS) is conducted by officials of the State Environmental Engineering Inspectorate, Head of the structural unit for metrological supervision, Chief State Inspector for metrological supervision and State Inspectors for metrological supervision. 

The subjects of the SMS in the field of technical regulation, i.e. in the development, adoption, application and implementation of mandatory requirements for products and/or related processes of design (including research), production, construction, installation, adjusting, storage, transportation, sale, operation and disposal, as well as mandatory conformity assessment, are:

- availability of the system ensuring control of the applied MIs;

- availability of a person responsible for the state of the applied MIs;

- availability of the approved schedule indicating the frequency of MI verification and control of its implementation;

- traceability of measurement standards and MIs;

- identification of measurement standards and documentation of their metrological and technical characteristics;

- availability of conditions for the operation of measurement standards and documented rules for the use and maintenance of measurement standards;

- compliance of the measurement uncertainty obtained as a result of calibration (verification) of the measurement standard with the requirements determined by the intended use of this standard;

- use of measurement standards only as a means of verification (calibration) or for interlaboratory comparisons and for no other purposes;

- use of measurement standards only by qualified personnel; appointment of personally responsible persons for measurement standards;

- availability of approved and recognized procedures for calibration/verification and use of measurement standards;

- establishment of recalibration (reverification) intervals determined according to the characteristics of measurement standards;

- availability and completeness of the list of MIs used in the field of state regulation of ensuring the uniformity of measurements;

- right to verify MIs by this legal entity;

- certification of measurement procedures used in the field of state regulation of ensuring the uniformity of measurements;

- type approval and verification of MIs used in the field of state regulation;

- compliance of the state of MIs and conditions of their operation with the established requirements in the form provided for in Appendix 2 to Regulation of May 31, 2012 No. 350 ;

- availability of documents confirming the certification of persons performing verification as verification officers;

- availability of verification documents and verification marks on the MI.

Legal metrology practitioners

Specialists, who carry out verification of measuring instruments, shall be certified as measuring instruments verification officers.

Certification of verification officers is performed in accordance with the Procedure for certification of measuring instruments verification officers, approved by the Decree of the Government of the Kyrgyz Republic of February 4, 2013 N 49.

Sanctions

Code of the Kyrgyz Republic on violations of April 13, 2017 No. 58.

 

Article 269. Violation of the procedure for the production, repair, sale and use of measuring equipment. Violation of the rules for the production, repair, sale, rental, verification, calibration or metrological certification of measuring equipment, measurements or conditions for using their results in areas covered by state metrological supervision, shall be subject to a fine of category 3.

 

Article 270. Violation of the rules for prepacking. Violation of the rules for prepacking or selling prepackages shall result in imposition of a fine of category 1.

 

Fine of category 1: for natural persons - 10 estimate indicators, for legal entities - 50 estimate indicators.

Fine of category 3: for natural persons - 55 estimate indicators, for legal entities - 170 estimate indicators.
